If we wrote to you about a planning application
Most people reading this page have had a letter or an email from us about a planning application, and want to know how we got their details. That is answered first.
Where your details came from
Every local planning authority keeps a planning register and publishes it on its website. Anyone can look at it. It contains the application, the site address, the description of the proposed work, and the names and contact details of applicants and their agents. That is where we got your details, and it is the only place we got them. We did not buy a list, and nobody passed your details to us. The authority whose register we used is named in the letter or email we sent you.
What we hold about you
- Your name, and your company name if you are acting professionally
- The postal address, email address or phone number published on the register
- The planning application reference, the site address, and the description of the proposed work as the authority published it
- Dates from the application, such as when it was validated or decided
- A record of any contact between us, including anything you have asked us to do or not do
Why we hold it
To find building work in our area and to offer our services to people who have publicly applied to build something. That is the only purpose. We do not profile you for any other reason and we do not sell or share your details with anyone for marketing.
Our lawful basis
We rely on legitimate interests under Article 6(1)(f) of the UK GDPR: our interest in offering our services to people who have publicly indicated that they intend to build. We have carried out and written down an assessment weighing that interest against your rights and freedoms, and recorded the safeguards we apply. You can ask us for a copy of it and we will send it to you. Alongside that, separate rules apply to how we are allowed to contact you:
- Post. We write to private individuals by post. Marketing by post is not covered by the electronic marketing rules.
- Email. We do not send unsolicited marketing emails to private individuals, because the Privacy and Electronic Communications Regulations require consent that we do not have. We do email businesses, and every email says who we are and how to stop it.
- Telephone. If we ever call you, we screen the number against the Telephone Preference Service and the Corporate Telephone Preference Service first, and we do not withhold our number.
How long we keep it
Twelve months from the last time we contacted you, or you contacted us. After that we delete it or strip out anything that identifies you. There is one exception. If you tell us not to contact you again, we keep the minimum record needed to make sure we do not: usually your name, and the email address or phone number to avoid. We keep that permanently, because it is the only way to honour what you asked for. We do not use it for anything else.
If you are a customer, or you contacted us
If you ask us for a quote, or we carry out work for you, we hold what we need to do the job and to meet our legal obligations: your contact details, the site address, quotations, drawings, correspondence, invoices and payment records. Our lawful basis is performance of a contract, or taking steps at your request before entering one, and legal obligation for the records we are required to keep. We keep quotation records for two years if the job does not go ahead, and job and financial records for six years after completion, or longer where building regulations, warranty or insurance requirements mean we should.
Who else sees your information
Nobody, for marketing purposes. We use ordinary business suppliers who may handle your information while providing a service to us: our email and IT providers, a printing or mailing service, our accountant, and our insurers. They act on our instructions and cannot use your information for their own purposes. We do not sell your information. We do not transfer it outside the UK except where an ordinary IT provider does so under an approved safeguard.
Your rights
You can ask us to:
- Stop contacting you. This is an absolute right where marketing is concerned. We do not need a reason and we will not ask for one.
- Show you what we hold. We will respond within one month.
- Correct anything that is wrong.
- Delete what we hold, or restrict what we do with it.
- Provide it in a portable form, where that right applies.
You can also object to our use of legitimate interests generally, and we will stop unless we have compelling grounds that override your rights. For marketing there is no such override. We simply stop.

We record your request on our suppression list on the same day, across post, email and phone, for every site and every application. You will not hear from us again.
Complaints
If you are unhappy with how we have handled your information, tell us first. Email info@jacjonesconstruction.co.uk, or write to the address above, and mark it for the attention of Jac Jones. We will acknowledge your complaint within 30 days and respond as quickly as we can after that, explaining what we have found and what we are doing about it. Changes to this notice
If we change how we use your information we will update this page and change the date at the top. Where the change is significant and we still hold your details, we will tell you directly.
